Individuals who use medical marijuana should remain aware that while some laws exist to specifically govern the qualifying uses medical marijuana, marijuana is still considered to be a controlled substance and as such, is subject to other applicable laws and regulations. There is also an absence of anti-discrimination laws that may expose patients to prosecution, discrimination or termination of employment as a result of their use of medical marijuana.
While the use of medical marijuana is legal in the state of Colorado for individuals with qualifying medical conditions, many existing laws still apply to the use of medical marijuana by individuals who are legally registered. There are also additional regulations that specify where medical marijuana may be used.
The Americans with Disabilities ACT (ADA) protects individuals with chronic and debilitating conditions from discrimination arising from their diagnosis. At the present time, there is no language included in the American with Disabilities Act to ensure that legitimate medical marijuana users are protected from discrimination under state and/or federal law.
Colorado’s medical marijuana law specifically states that employers are not required to accommodate the use of medical marijuana in the workplace. In addition, Colorado currently does not have any laws that exempt medical marijuana patients from employment-related drug testing. There is no law that specifically permits or prohibits an employer from terminating an employee specifically for using medical marijuana.
